How has this happened?

The Equality Act 2010 (formerly the Equal Pay Act) states that employees owe their male and female employees equal pay for equal work. Despite this, we believe Asda has been paying store workers less than their warehouse colleagues. We believe this is an injustice.

Why should I join?
Demanding equal pay for equal work

You deserve equal pay. The law states that employees should be paid equally for work of the same value, and we believe Asda has been defying this law by underpaying you - potentially for years. If your Equal Pay claim is successful, you may be entitled to:

1. Back pay for up to 6 years.

2. Additional pay for the hours you work whilst your claim progresses.

Most claims will be worth over £1,000, although your value will depend on your hourly rate and length of service.

Potential to increase future earnings

If successful, your claim won’t just entitle you to back pay for hours you’ve already worked. You may also be entitled to an increase in your hourly rate for all future pay.

How much am I owed by Asda?

You may have been paid between £1 and £3 per hour less than you should have been. If you multiply that by your working hours over the last six years you can get a rough idea of how much your claim could be worth.

Most claimants are seeking more than £5,000. Your claim might be worth less or more; it will depend on lots of factors, including how many hours you worked, how long you worked at the supermarket, and the distribution role it is most appropriate to compare your job with.

If you still work at Asda, we will also seek to increase your hourly rate and improve your future pay.

Will I lose my job or be disciplined for making a claim against Asda?

Absolutely not. You can continue to work for your employer at the same time as bringing a claim and exercising your right to claim should not affect your ongoing employment in any way.

It would be unlawful for your employer to treat you differently due to bringing the claim, and if you feel that you are being treated differently by your employer because of your claim, contact us immediately.

I’m a man. Can I make a claim?

Yes! Your claim will be a ‘piggyback’ claim, based on the idea that if women doing store work succeed in their claim for higher pay, it would be unfair if male store workers’ pay did not rise too.

Although your claim would depend on female claimants winning their claims, it is possible to lodge your claim now, at the same time as the women’s claims.

Am I eligible to join the Asda Equal Pay Claim?

If the following conditions apply, you are eligible to join the Equal Pay claim:

  • You work for one of the following supermarkets now or have in the last 6 years:
    • Asda
    • Tesco
    • Morrisons
    • Sainsbury’s
  • Your job is/was in the store of any of these supermarkets.
  • You are/were paid at an hourly rate.
How much will it cost me?

The claim is no win, no fee. This means that, as long as you comply with the terms of our retainer, you will only pay if your claim is successful, and you receive some money.

You will not have to pay any costs if your claim is unsuccessful or if you are not awarded any compensation.

You will not have to pay any upfront costs to join the claim. Additionally, we will cover all of the costs associated with pursuing your claim, including court fees, and fees for experts and council.

If your claim is successful, we will charge you no more than 24% of the compensation you receive, plus VAT if applicable, and a share of disbursements (expert fees and so on).

I’m a former Asda employee. Can I make a claim?

Yes, absolutely. You are eligible to join the Equal Pay claim if you worked for one of the following supermarkets in the last 6 years:

  • Asda
  • Morrisons
  • Tesco
  • Sainsbury's
Which other supermarkets are facing equal pay challenges?

Whilst many supermarkets and high street shops are facing claims for equal pay, we are representing clients bringing claims against Asda, Tesco, Sainsbury’s and Morrisons.

Of the four cases, the furthest advanced is Asda where the claimants have established that their jobs may be compared to those of their warehouse or depot colleagues.

I have worked at another supermarket alongside Asda. Can I join both claims?

Yes, you can! If your employment ended within the last 6 years, then you can join any of the claims. There is no maximum limit to the number of claims you can sign up to.

Do I need to be a union member to claim?

No. You can register to be part of the claim whether you are a member of a union.
